29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a. Where employees were exposed to noise during press operation, 8-hour time weighted average (TWA) noise monitoring was not conducted to determine the need for a hearing conservation program (initial and annual hearing conservation training and hearing tests). (Note: sound level meter measurements ranged from 89.5 to 97. 0 dBA on the day of inspection. Abatement could be made by instituting a hearing conservation program without 8-hour TWA monitoring.) Abatement documentation is required for this violation.

A respiratory protection program was not written, to address the use of a supplied air respirator, which was used for spray painting of solvent based paint, and including maintenance of the respirator and supplied air system, how the respirator user was trained, and how supervision was to be provided to ensure correct use of the respirator and supplied air system. Abatement documentation is required for this violation.
