OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards.     An employee was assigned to sandblast steel counterweights which were three feet ten inches (3 10") tall, two feet eleven inches (2 11") wide and three inches (3") thick.  The counterweights were placed free standing on the three inch wide end when being sandblasted, thereby creating a tip over and crush hazard.

29 CFR 1910.134(e)(1):   The employer did not provide a medical evaluation to determine the employees ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace:  Employees painting equipment were required to wear tight fitting, cartridge type, half mask respirators and the employer had not provided medical evaluations to determine the employees ability to wear a respirator before the employee was required to wear the respirator in the work place.

29 CFR 1910.134(i)(7):   For oil-lubricated compressors, the employer did not ensure a carbon monoxide alarm or a high-temperature alarm and carbon monoxide monitoring was conducted at intervals sufficient to prevent carbon monoxide in the breathing air from exceeding 10 ppm:    An employee sandblasting was wearing a supplied air respirator hood that was attached to an oil-lubricated compressor and the compressor did not have a carbon monoxide alarm or a high-temperature alarm and carbon monoxide monitoring.
