29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  a) At the barge terminal, the employer did not develop and implement a monitoring program to determine the equivalent exposure levels for employees operating high noise equipment including but not limited to the Link Belt LS108B crane operation. The sound levels ranged from 88 - 91 dBA during equipment operations.  b) At the weld shop, the employer did not develop and implement a monitoring program to determine the equivalent exposure levels for employees conducting high noise operations including but not limited to carbon arc cutting, grinding, sand blasting, concrete sawing operations, welding and cutting operations.

29 CFR 1917.111(d): All walking and working surfaces in the terminal areas were not maintained in good repair:      (a) At the barge terminal, the dock gangway was deficient in that there was a 5 inch gap between the bank and the gangway where a worker could trip when stepping onto the gangway.

29 CFR 1917.112(b)(1): Guardrails were not provided at locations where employees were exposed to floor or wall openings or waterside edges, including bridges or gangway-like structures leading to pilings or vessel mooring or berthing installations, which presented a hazard of falling more than 4 feet or into the water:    (a) (a) At the barge terminal discharge spout, a guardrail was deficient in that the railing was missing leaving a 25 inch gap where employees could fall approximately 3-4 feet onto a concrete abutment.    (b) At the barge terminal, the guardrail for the walkway to the barge was deficient in that the pole was bent causing the wire rope to sag where employees could fall approximately 10-15 feet into water.

29 CFR 1917.112(c)(2): Guardrails which were not of solid baluster, or similar construction, did not consist of top rails and midrails:    (a)   At the Barge Terminal Dock, the catwalk access to set the slide guard in place did not contain mid-rails to protect employees from falls of approximately 12-15 feet into the water or onto the concrete pier.      (b) At the Barge Terminal Dock, the wire rope railing was deficient in that the mid-rail left a gap greater than 30 inches where employees could fall into the water.
