29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. a) On or about 04/11/14, on the upper roof of the Best Western Summit Inn, 9500 Niagara Falls Blvd., Niagara Falls, NY: One employee was exposed to a fall of approx. 20 ft. from the edge of the upper roof to the ground, and/or a fall of 9 ft. 7 in. from the edge of the upper roof to the lower roof while operating a pressure washer to locate and repair a roof leak. No fall protection system was utilized. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders' length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or about 04/11/14, at the ladder access point to the lower roof of the Best Western Summit Inn, 9500 Niagara Falls Blvd., Niagara Falls, NY: Employee was exposed to a fall of up to 11 ft 6 in. because the siderails of an extension ladder used to access the lower roof from the ground only extended approx. 18 inches above the edge of the lower roof. b) On or about 04/11/14, at the ladder access point to the upper roof of the Best Western Summit Inn, 9500 Niagara Falls Blvd., Niagara Falls, NY: Employee was exposed to a fall of up to 9 ft. 7 in. because the siderails of an extension ladder used to access the upper roof from the lower roof only extended approx. 20 inches above the edge of the upper roof. NO ABATEMENT CERTIFICATION REQUIRED
