29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  (a) Work bench on back side, new townhome construction located at 13329 Flamingo Road, Milton, GA 30004: Employee operating a Makita (Model 5007NB) 7-1/4-inch Circular Saw with diamond blade was exposed to eye injuries while cutting concrete based Hardie-Plank Lap Siding without eye protection.   (b) Aluminum plank on back lower roof, new townhome construction located at 13329 Flamingo Road, Milton, GA 30004: Employee operating a Hitachi (Model-Nt50A) and a DUO-FAST (Model-CNP-65Y) was exposed to eye injuries while installing siding and cornice boards with these pneumatic tools without eye protection. Employees were exposed to fasteners and flying debris as safety glasses and or goggles were not worn.

29 CFR 1926.300(a): Hand tool(s), power tool(s) or similar equipment were not maintained in a safe condition:  (a) Lower rear roof, new townhome construction located at 13329 Flamingo Road, Milton, GA 30004: Employee was exposed to struck-by hazards from the unintended discharge of siding fasteners as the contact safety tip on the DUO-FAST (Model-CNP-65Y) Siding Coil Nail Gun was disabled by jamming nails between the safety tip and the nail chamber. This power tool was not operating as intended by the manufacturer which can cause injury to the operator during use.

Employee was exposed to amputation hazards while cutting Hardie Plank Lap Siding with a Makita (Model-5007NB) 7 1/4-inch Circular Saw with the guard propped open with a wood shim.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:  (a) Rear side, new townhome construction located at 13329 Flamingo Road, Milton, GA 30004:  Employees were exposed to electrical shock hazards while using an electrical junction box which was connected to a flexible cord and used as a makeshift power outlet. The junction box used is intended for indoor use and is manufactured to be fixed to a support within a structure.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Rear lower roof, new townhome construction located at 13329 Flamingo Road, Milton, GA 30004: Employees were exposed to falls while installing Hardie-Plank Lap Siding from a 4/12 pitched roof at heights of approximately 14-feet, 7-inches with no fall protection system in place.
