29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph.    a- Swimming River Treatment Plant Tank #1, 310 Swimming River Road, Colts Neck NJ: An employee suffered severe injuries, when the scaffold collapsed that was in the process of being moved horizontally.  Prior to the move, this scaffold was not restrained from tipping as its height was approximately 542 inches (approximately 45.17 feet) and the widest section of its base was approximately 120 inches (approximately 10 feet). Condition existed on or about 04/15/14.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

Condition existed on or about 04/15/14.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. This scaffold was not designed by a registered professional engineer at the time of the incident. Condition existed on or about 04/15/14.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees selected by, and under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration.    a- Swimming River Treatment Plant Tank #1, 310 Swimming River Road, Colts Neck NJ: An employee suffered severe injuries, when a scaffold collapsed that was in the process of being moved horizontally.  This scaffold was not moved and erected under the supervision and direction of a competent person and, as such, contained the following deficiencies:  1) was not restrained from tipping as its height was approximately 542 inches (approximately 45.17 feet) and the widest section of its base was approximately 120 inches (approximately 10 feet) - greater than the 4:1 ratio, 2) did not contain a rest platform for the scaffold's attached ladder, 3) contained an un-rated rope attached to the scaffold's upper hand rail by a single knot and was used by employees for fall protection when accessing/egressing the scaffold's attached ladder, and 4) scaffold was moved with an employee on its upper walking/working surface. Condition existed on or about 04/15/14.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
