29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    (a)Weymouth-Young Construction LLC, at 1530 S Hazel Court, Denver, CO: On 4/16/14, Weymouth-Young Construction LLC, the controlling contractor, did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. The controlling contractor directed the work of subcontractor employees connecting a sewer line while working in an approximate 5.3 to 6.5 foot deep section of an excavation. The spoil piles extended to the edges of the excavation.  Protective systems were not constructed correctly. The controlling contractor did not maintain a safety program which provided for frequent and regular inspections of the jobsite to ensure subcontractor employees were not exposed to cave-in hazards.
