29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s).    On or about April 11, 2014, and at times prior thereto, the employer did not ensure that the Nissan forklift that is used for handling furniture was taken out of service until the severely worn tires were repaired, exposing employees to the hazard of being struck by the forklift.

29 CFR 1910.178(q)(7): Industrial trucks were being placed in services after the examination showed condition(s) adversely affecting the safety of the vehicle:  On or about April 11, 2014, and at times prior thereto, the employer placed the Nissan forklift in service after an examination showed that the tires were severely worn, exposing employees to the hazards of being struck by the forklift.
