29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a. On or about April 21, 2014, at the above addressed jobsite, an employee conducting roofing operations with a pneumatic nail gun (Hitachi NV 45AB2) was not wearing safety glasses, thereby exposing the employee to stuck by hazards.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access: a. On or about April 21, 2014 - at the above addressed jobsite, an employee conducting roofing operations from a ladder jack scaffold, approximately sixteen (16) feet four (4) inches above the ground,was not provided with an access ladder, thereby exposing the employee to fall hazards.

On or about April 21, 2014, at the above addressed jobsite, an employee performing roofing operations from a ladder jack scaffold, approximately sixteen (16) feet four (4) inches above the ground, was not protected from falls by a personal fall arrest system, thereby exposing the employees to falls.

On or about April 21, 2014, at the above addressed jobsite, an employee performing roofing operations from a ladder jack scaffold, approximately sixteen (16) feet four (4) inches above the ground, was not trained to recognize the hazards associated with scaffolding. The employee was thereby exposed to the hazards associated with falls.
