OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:  a) On or about 4/13/14 in the warehouse area; the employer did not conduct and did not document training for those employees operating the American Baler Company closed door horizontal baler, model # PW3560L-820, serial # 9438312. Employees were not instructed in the safe work methods as described by the manufacturer. Training records identifying the names of the employees and the date of instruction were not maintained.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    a. Warehouse - for employees opening the hopper door of the American Baler Company closed door horizontal baler, model # PW3560L-820, serial # 9438312 to remove or unjam cardboard boxes. Violation observed on or about 5/13/14.    b. Warehouse - for employees using a poker tool and hammer to create a hole/passage way in the cardboard so the tying wire can be inserted into the platen wire slots from the top of the baler. Violation observed on or about 4/13/14.
