29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    (a) Construction Site: On or about April 21, 2014 and at times prior, as the controlling employer, Wadsworth Builders Company, Inc.,  did not ensure its sub-contractor, CK May Excavating Inc., protected their employees in that employees were exposed to a trench cave in without a means to egress the trench.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:     (a)   Construction Site: On or about April 21, 2014 and at times prior, as the controlling employer, Wadsworth Builders Company, Inc.,  did not ensure its sub-contractor, CK May Excavating Inc., protected their employees in that employees were exposed to a trench cave while working in a trench with approximately one foot of water accumulation in the bottom.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, and indications of failure of protective systems:       (a) Construction Site: On or about April 21, 2014 and at times prior, as the controlling employer, Wadsworth Builders Company, Inc.,  did not ensure its sub-contractor, CK May Excavating Inc., protected their employees in that employees were exposed to a trench cave in while conducting a sewer extension operations in a trench of Class "C" soil with hazards such as, but not limited to; no means of egress in the trench, inadequate trench box, and an accumulation of water in the trench.
