29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    On April 23, 2013, an employee was not propected from a cave-in while working in a 6'10" trench, exposing the employee to the hazards associated with a cave-in.     Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.    On April 23, 2014 an employee was exposed to the hazrds associated with using a portable ladder that was missing a rung.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
