29 CFR 1926.501(b)(1): Employee on a walking/working surface having an unprotected side or edge which is six feet or more above a lower level were not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system:    a) 326-328 Suydam Street, New Brunswick, NJ 08901. The employer was working on and from an unguarded, job-made, timber walking/working platform with no fall protection systems in place, i.e. guardrails installed along all open sides and ends.     Condition occurred on or about 04/24/14.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:    a) 326-328 Suydam Street, New Brunswick, NJ 08901. The employer did not provide adequate instruction in avoidance of unsafe conditions in that employees were allowed to work on and from an unguarded walking/working platforms and an unguarded job-made, timber cantilevered scaffolds.      Condition occurred on or about 04/24/14.          Melvin Rivera DBA Rivera Carpentry was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 315656025, citation number 1, item number 2(a) and was affirmed as a final order on 07/21/2011, with respect to a workplace located 310 3rd. Street, Lakewood, NJ.

The employer allowed his employees to work on and from an unguarded, job-made, timber cantilevered scaffold with no fall protection systems in place, i.e. guardrails installed along all open sides and ends of walking/working platforms.      Condition occurred on or about 04/24/14.          Melvin Rivera DBA Rivera Carpentry was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 315656025, citation number 1, item number 5 and was affirmed as a final order on 07/21/2011, with respect to a workplace located at 310 3rd.
