29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)  At the jobsite, on the roof, on or about 4/3/14:  Workers were sheathing a 4:12 pitch roof, with an approximate 13 foot ground to eave height, without fall protection of any kind and accessed the roof via a ladder that did not extend at least 3 feet above that surface.    Abatement certification must be submitted for this item.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  a)  At the jobsite, on the roof, on or about 4/3/14:  Workers were sheathing a 4:12 pitch roof, with an approximate 13 foot ground to eave height, without fall protection of any kind, accessed the roof via a ladder that did not extend at least 3 feet above that surface, and were not trained on the safe use of ladders.    Abatement certification must be submitted for this item.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a)  At the jobsite, on the roof, on or about 4/3/14:  Workers were sheathing a 4:12 pitch roof, with an approximate 13 foot ground to eave height, without fall protection of any kind.  Dion Martin (DBA Dion Martin Enterprises LLC) was previously cited for a violation of this occupational safety and health standard CFR 1926.501(b)(13), which was contained in OSHA inspection number 873323, citation number 1, item number 1a and was affirmed as a final order on 11/11/13, with respect to a workplace located at Jamesville Grove Subdivision Lot 1A, Jamesville, NY.  Abatement certification must be submitted for this item.
