29 CFR 1926.95(a):  Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided or used by reason of mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through physical contact:                                                                                            112 Vine St., Yutan, NE 68073 (Jobsite): The employer is failing to assess the job task involving an employees use of a jackhammer to determine if hazards are present, or are likely to be present, which necessitated the use of personal protective equipment (PPE) which was not provided or used. An employee who was using a jackhammer was injured when the jackhammer lacerated his toe. The employee had no foot protection on at the time of the incident.      Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed.
