29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:  a. On or about May 16, 2014, at the above located jobsite, employees were provided with and required to wear a tight fitting full face respirator for use during application of a fire retardant. The employer did not develop or implement a written respirator program that included the provisions with worksite specific procedures for mandatory use.

Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH:    a. On or about May 16, 2014, at the above addressed jobsite, employees applying a fire retardant which included chemicals including, but not limited to Tertiary Butyl Acetate and 1,2,4 Trimethyl Benzene, were exposed to the respiratory hazards, in that the employer failed to evaluate the respiratory hazards(s) at the worksite.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets:  a. On or about May 16, 2014, at the above located jobsite, employees were required to apply a fire retardant which chemicals including, but not limited to tertiary butyl acetate and 1,2,4 Trimethyl Benzene. The employer did not provide specific training of the hazards associated with these chemicals.
