OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to hazards associated with being crushed or struck by falling objects as a result of damaged storage racks.    This violation was discovered on May 7, 2014 and at times prior thereto when employees working in the warehouse were exposed to struck-by and crush-by hazards from damaged storage racks.

29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse:      This violation was discovered on May 7, 2014 and at times prior thereto when employees working in the warehouse were exposed to struck-by and crush-by hazards from improperly stored pallets.       a.     In row AV a pallet of wind deflectors (50 units per pallet) stored on the top rack in the north-west corner of the end cap was improperly stored and leaning;       b.     In row AR a pallet in the middle of the top storage rack was improperly stored and leaning;       c.     In row AC a pallet was observed hanging over the edge of the rack and was not properly wrapped.  The pallet was slanting toward the edge of the rack;       d.    In row AE a pallet was uneven and leaning.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator of industrial powered trucks had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate industrial powered vehicles.                            This violation occurred on or about May 2, 2014, and at times prior thereto, where employees, who were not trained, were using industrial powered tracks to move pallets throughout the warehouse.
