29 CFR 1926.62(d)(1)(i): Each employer who had a workplace or operation covered by 29 CFR 1926.62 did not initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air (30 ug/m3) calculated as an 8-hour time-weighted average (TWA):        a) 36 Mercer Street-Princeton, NJ: On or about 05/13/14, the employer did not perform an initial evaluation to determine if employees who were performing paint scraping and restorative painting to a structure were exposed to lead at or above the action level.        NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.62(l)(1)(i): The employer shall include lead in the program established to comply with the Hazard Communication Standard (HCS) (� 1910.1200) within which at least the following health hazards of Reproductive/developmental toxicity; Central nervous system effects; Kidney effects; Blood effects; and Acute toxicity effects;  are addressed:      a) 36 Mercer Street-Princeton, NJ: On or about 05/13/14, the employer did not have a written hazard communication program which discussed the health hazards of lead exposure while performing lead paint removal operations on a structure.         NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
