29 CFR 1910.95(c)(1): 29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour time-weighted average (TWA) sound level of 85 dBA: (a) On or about May 13, 2013 a Laborer was exposed to continuous noise at 219% of the permissible daily noise (8-hour time- weighted average sound level of 90 dB) or an equivalent sound level of approximately 96 dBA during the 438 minute sampling period on 05/13/14. Exposure calculations included a zero increment for the time not sampled. (b) On or about May 13, 2013 a Laborer was exposed to continuous noise at 178% of the permissible daily noise (8-hour time- weighted average sound level of 90 dB) or an equivalent sound level of approximately 94 dBA during the 430 minute sampling period on 05/13/14. Exposure calculations included a zero increment for the time not sampled. (c) On or about May 13, 2013 a Cut Off Saw Operator was exposed to continuous noise at 172% of the permissible daily noise (8-hour time- weighted average sound level of 90 dB) or an equivalent sound level of approximately 94 dBA during the 437 minute sampling period on 05/13/14. Exposure calculations included a zero increment for the time not sampled. (d) On or about May 13, 2013 a Laborer was exposed to continuous noise at 86% of the permissible daily noise (8-hour time- weighted average sound level of 90 dB) or an equivalent sound level of approximately 89 dBA during the 423 minute sampling period on 05/13/14. Exposure calculations included a zero increment for the time not sampled.

Vehicles shall not be serviced within 10 feet of containers. (a) Storage Area - On or about May 13, 2014 a gasoline tank was not guarded and or protected from vehicular traffic exposing the forklift operators to a fire and explosion hazard.
