29 CFR 1910.146(d)(1): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not implement the measures necessary to prevent unauthorized entry. The employer failed to implement the measures necessary to prevent unauthorized entry to a permit-required confined space area. This violation occurred on or about May 15, 2014, and at times prior thereto, in the Tank 940, where employees were exposed to oxygen deficient hazard while working around an unattended permit-required confined space that was open and without the measures necessary to prevent unauthorized entry. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that they implement the measures necessary to prevent unauthorized entry to a permit-required confined space.

29 CFR 1910.146(c)(5)(ii)(B): When an entrance cover was removed, the opening was not promptly guarded by a railing, temporary cover, or other temporary barrier that would prevent an accidental fall through the opening and that would protect each employee. The employer failed to promptly guard the entrance of the confined space by a railing, temporary cover, or other temporary barrier after the entrance cover was removed. This violation occurred on or about May 15, 2014, and at times prior thereto, in the Tank 940, where employees were exposed to oxygen deficient hazard while working around an unguarded permit-required confined space opening. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that they implement the measures necessary to promptly guard the entrance of the confined space after the entrance cover was removed.
