29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: The employer did not ensure all persons involved with work associated activities on unprotected platforms elevated on the forks of a forklift also working in close proximity to an energized 240V distribution service drop had been trained and knowledgeable of the applicable hazard potentials associated to electrical safety related work practices, elevated safety platform requirements associated with work on the forks of a forklift and associated forklift/scaffolding regulations.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. Located along the side area of the structure a worker was observed working from a wooded pallet which was not protected by standard guardrails or equivalent elevated on the forks of a Hyster H80XL forklift and was exposed to a fall potential in excess of 11.
