29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  On or about May 21, 2014, an employee was constructing a retaining wall in an excavation directly in front of a six foot soil wall without the use of an adequate protective system, exposing the employee to caught in hazards from a cave-in.
