29 CFR 1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use:  a) For the Syfrett Feed facility as observed on or about 05/20/2014, a respiratory protection program was not in place for employees who were required to use N-95 filtering face piece (dust mask) respirators or employees who were required to use full face positive pressure air purifying respirators. Employees using respirators had not been fit tested or medically evaluated for respirator use. A respiratory protection program was not in place at the facility to ensure that respirators were safely maintained, employees were trained how to use a respirator, that employees using a respirator received medical evaluations and were fit tested, and that all other requirements of 29 CFR 1910.134 were met.  Syfrett Feed Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1910.134(c)), which was contained in OSHA inspection number 944956, citation number 2, item number 2, and was affirmed as a final order on 02/11/2014 with respect to a workplace located at 3079 NW 8 St., Okeechobee, FL 34972.

29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:  For the Syfrett Feed facility as observed on or about 05/20/2014, The employer's written confined space program was deficient in the following areas:  a) The employer's written confined space program did not mention the contacting of local emergency services even though this was the rescue option that the employer had elected to use for retrieval.   b) The employer's confined space program did not identify all persons who had active roles in the confined space program and state what their role was. Roles such as, but not limited to, attendants, authorized entrants, and people to test and monitor the atmosphere were not identified in the employer's confined space program.  c) The employer's confined space program did not ensure that the mixer was labeled as a permit required confined space.
