29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  On or about 21 May 2014, and at times prior thereto, a concrete worker was using a Makita hand-held gas powered saw to cut lengths of rebar that were to be used in the pouring of concrete without the use of face or eye protection, exposing the worker to the hazard of being struck by flying sparks and objects to the face and eyes.
