29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:   Select Portenzo employees were exposed in the company's wood shop area to potential adverse health conditions when the employer failed to establish and implement those elements of a written respiratory protection program needed to ensure the safe, voluntary usage of respirators:  - Conduct a medical evaluation to determine the employees ability to use a respirator; - Train employees on the proper use and effective maintenance of elastomeric respirators; - Ensure that employees did not have facial hair while wearing tight-fitting respirator facepieces; - Provide employees voluntarily wearing filtering face piece and elastomeric respirators with copies of Appendix D of 29 CFR 1926.134.
