OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to explosion hazards and sharp particles flying in the air:  a) Production Area - Employees were exposed to flying plastic projectile hazards due to possible mechanical failure of the plastic polyvinyl chloride (PVC) piping system used to transport compressed air, exposing employees to serious physical hazards which could result in lacerations to the body and damage to the eyes resulting in hospitalization.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a)  Powder Room - The employer did not establish a written respiratory protection program, to include training, medical evaluations, and fit testing, for the employees required to wear an Elvex N95 disposable respirator while encapsulating pills.
