29 CFR 1910.134(c)(2)(i):The employer provides respirators at the request of employees or permits employees to use their own respirators, the employer determines that such respirator use will not in itself create a hazard. The employer determined that voluntary respirator use is permissible, but the employer did not provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard").  This violation was discovered on or about May 30, 2014, where employees were exposed to respiratory hazards because the employer did not provide his employees with the Appendix D precautions to prevent misuse, contamination and warning of the limitations of the respirators.
