29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:      Location: Buffing/Polishing Area      Two employees working in the buffing/polishing department were exposed to noise levels above the Action Level of 85 dBA, and the employer had not developed or implemented a Hearing Conservation Program that included:    1) Training  2) Provision of annual audiometric tests  3) Performance of periodic noise surveys to determine if employees are being exposed above the PEL    The employees were exposed to 8-hour time-weighted averages of:    1) Elias Giron:  87.8 dBA, or 73.7% Dose  2) Otilio Trejo: 90.2 dBA, or 103% Dose
