At the worksite where an employee worked below employees on the roof of the gas station, the employee's head was not protected by the use of a hard hat, thereby being exposed to struck-by hazards.

29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents.  a. On the roof of the gas station where employees used a circular saw to cut and an air actuated nail gun to install shingles, employees were not provided with eye protection, thereby being exposed to struck-by hazards.

29 CFR 1926.501(b)(11): "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  a. On the roof of the gas station where employees were installing sheeting and shingles, the employees were not protected from falls by the use of, but not limited to, personal fall arrest systems, thereby being exposed to a 16 foot fall hazard.
