OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a fall hazard:       Jobsite:  The employer did not ensure through utilizing and exercising appropriate means, such as (but not limited to) providing specific instructions, specific trainings and/or performing visual observation that the employees, required to perform a Tower Industry Association Climb (TIA) inspection of the communication tower, No. 84129 were protected from the hazard of falling at all times while ascending/descending the tower.      On or about 5/31/2014, one of the employees fell approximately 70 feet to the ground while descending the tower due to the carrier of the ladder safety device was detached from the bottom of the bracket. The employee sustained very serious injuries from the incident.

29 CFR 1910.268(h)(2): The spacing between steps or rungs permanently installed on poles and towers was not more than 18 inches (36 inches on any one side). This requirement also applies to fixed ladders on towers, when towers are so equipped. Spacing between steps was not uniform above the initial un-stepped section, except where working, standing, or access steps are required. Fixed ladder rungs and step rungs for poles and towers did not have a minimum diameter of 5/8". Fixed ladder rungs did not have a minimum clear width of 12 inches. Steps for poles and towers did not have a minimum clear width of 4 1/2 inches. The spacing between detachable steps did not exceed 30 inches on any one side, and these steps were not properly secured when in use.    Jobsite: The employer did not ensure that all the detachable steps were properly secured in place when in use to prevent the employees from falls.
