OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards while using an automotive lift:  (a)  On or about June 3, 2014, and at times prior, the employer did not ensure that employees were safe from crushing and struck-by hazards while using the Challenger Versymmetric Lift, Model 39000, in that the automotive lift exhibited defects such as, but not limited to, swing arms on the left side that would inadvertently move while they were elevated, as well as uncharacteristic vibration and noise.  Further, the employer required employees to regularly lift vehicles that exceeded the lift's rated weight capacity.  Additionally, vehicles with frames that were too large for the lift were raised by the lift necessitating the employee's use of unrated, unlisted and uncertified wooden blocks on the lifting pads to increase the height of the contact points.  (b)  On or about June 3, 2014, and at times prior, the employer did not document that all lift users were trained to use the lifts.
