OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to inhalation and exposures of Ammonia.   On or about 6/10/14, at the Gainesville facility, employees were exposed to ammonia hazards as the employer did not ensure the room was enclosed (13.1.1.3), was equipped with tight fitting doors that had panic type hardware rather than a rollup door (13.1.10.2) and had an exit discharging directly outside from the engine room (13.1.10.3).     This hazard is recognized in safety documents: ANSI/IIAR 2-2008  Equipment, Design and Installation of Closed Circuit Ammonia Mechanical Refrigeration Systems, 13.1 Machinery Room Design, Addendum A.   29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed.    On or about 6/10/14, at the Gainesville facility, the employer did not ensure egress routes on the roof were kept free and unobstructed in that refrigeration employees had to climb over and under ammonia refrigeration piping and traverse different elevations (14 in. apart) in the egress path in the event of an emergency.     In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

On or about 6/10/14, the employer did not establish written procedures to maintain new equipment added to the ammonia refrigeration system at the facility at the time of their implementation. Equipment includes:    1  High Pressure Receiver (York #163578) placed on line 5/26/2014  2  Recirculator (Frick #115067) placed on line 6/9/2014    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

On or about 6/10/14, the employer did not implement procedures to manage changes to the ammonia refrigeration system at the facility when new equipment/processes were installed as a part of an ongoing MOC at the facility at the time of their implementation. 29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use.  On or about 6/10/14, at the Gainesville facility, the emergency eye wash was not unobstructed an available for immediate use in that a thick vinyl curtain was hung across the doorway where the eyewash/shower combo was located.   Abated/Corrected during inspection.  29 CFR 1910.119(d): The employer did not complete a compilation of written process safety information pertaining to the equipment in the process.    On or about 6/10/14, at the Koch Foods Gainesville facility, the employer did not have process safety information for the following pieces of equipment that were in service/use:    1- ACC-1 Accumulator  located in engine room   2 - INT-1 Intercooler - located in engine room   3 - LTR-1 Recirculator - located in engine room     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information on paragraph (d) of this section) in a safe and timely manner when necessary means where taken to assure safe operation.    On or about 6/10/14, at the Koch Foods Gainesville facility, employees were exposed to inhalation and death by hazards in the Ammonia refrigeration machinery room and surrounding areas as the employer did not ensure deficiencies in Ammonia refrigeration equipment was corrected as soon as possible. The following deficiencies existed:     1  Piping insulation is damaged and in need of repair  2  Exhaust louvers are hinged louvers and not the fail open type   3  Oil Pots 2 and 3 relief valves have reducer bushings in the outlet side of the equipment       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
