29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: On or about June 12, 2014 at a job site located at 4080 Embassy Parkway, Fairlawn, OH, during construction activities including but not limited to masonry work from an elevated platform, the employer did not ensure employees working from an elevated platform were protected from fall hazards approximately 40 feet by a guardrail system.

29 CFR 1926.451(d)(3)(i): Before the scaffold was used, direct connections were not evaluated by a competent person to confirm, based on the evaluation, that the supporting surfaces are capable of supporting the loads to be imposed: On or about June 12, 2014 at a job site located at 4080 Embassy Parkway, Fairlawn, OH, during construction activities including but not limited to masonry work from an elevated platform, the employer did not ensure the fabricated frame scaffold was capable of supporting the loads on the access rungs. Employees were using the built in ladder rungs as working levels and the manufacture has no load limits information for these areas and recommends these levels not to be used as working levels.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access: On or about June 12, 2014 at a job site located at 4080 Embassy Parkway, Fairlawn, OH, during construction activities including but not limited to masonry work from an elevated platform, the employer did not ensure employees working from an elevated platform were provided proper access to different levels.
