29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the laddes length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)  The Villas at Highgate, King Way - On or about June 13, 2013, the ladder accessing the 7/12 pitch roof, 25 feet above grade, did not extend at least three feet above the upper landing.  b)  The Villas at Highgate, King Way - On or about June 13, 2013, the ladder accessing the overhang roof of the garage, 14 foot above grade, did not extend at least three feet above the landing.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  a)  The Villas at Highgate, King Way - On or about June 13, 2013, the 28 foot Louisville aluminum extension ladder used by employees to access 25 foot roof, had four rungs that were damaged and not taken out of service.

Fox Contracting was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 891032, citation number 1, item number 1 and was affirmed as a final order on June 7, 2013, with respect to a workplace located at Biltmore Estates, Lot 1139, Skippack, PA.

Fox Contracting was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 314728627, citation number 1, item number 3 and was affirmed as a final order on March 16, 2012, with respect to a workplace located at the Residence at Towamencin Town Square, Kulpsville, PA; and OSHA Inspection No. 894780, Citation number 1, item 1 and was affirmed a final order on June 7, 2013, with respect to a workplace located at 419 McNair Dr., Northampton, PA; and Inspection number 891032, Citation number 1, item number 2a, which became a final order on June 7, 2013, with respect to a workplace located at Biltmore Estates, Lot 1139, Skippack, PA.

29 CFR 1926.502(d)(17): The attachment point of the body belt was not located in the center of the wearer's back. The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head.  a)  The Villas at Highgate, Kings Way - On or about June 13, 2013, employees were conducting roofing work, no less than 25 feet above grade.  The employee donned full body harness and while using a rope grab system and connected to either the front of the nylon webbing of a personal fall arrest harness or wrapped around waist.  Fox Contracting was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 891032, citation number 1, item number 2b and was affirmed as a final order on June 7, 2013, with respect to a workplace located at Biltmore Estates, Lot 1139, Skippack, PA.
