29 CFR 1926.651(i)(2): Excavation below the level of the base or footing of any foundation or retaining wall that could be reasonably expected to pose a hazard to the employees was not prohibited: a) Basement Employees were digging an existing lower level to increase head room and had undermined the structures foundation wall footers and exposed to a crushing hazard in the event of a building collapse, on or about 06/10/2014. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) Basement - The competent person did not remove employees from an excavation where underpinning the foundation wall was not performed, exposing employees to a crush hazard caused by a collapse of the structure, on or about 06/10/2014. Abatement certification and documentation required within 10 days after abatement date.
