29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet (1.22 m) or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: On or about June 16, 2014, and at times prior thereto, at the fuels building at the Brady Mountain Resort, located along Brady Mountain Marina Road in Royal, Arkansas, employees were required to climb onto the roof of the building to probe fuel tanks. The platform the employer provided on top of the roof did not have a guard rail on the north east or west sides. These conditions exposed the employees to the hazard of falling from heights of approximately 10 to 13 feet to the ground below.

29 CFR 1910.24(e): Fixed stairs were not installed at angles to the horizontal of between 30 degrees and 50 degrees: On or about June 16, 2014, and at times prior thereto, at the fuels building of the Brady Mountain Resort's Marina, located along Brady Mountain Mariana Road, in Royal, Arkansas, employees were required to climb fixed stairs in order to access the roof of the building to probe the fuel tanks. The stairs were constructed at an angle of approximately 70 degrees to the horizontal, exposing employees the hazard of falling from heights of up to approximately 13 feet to the ground below.
