Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees, in that employees were exposed to a struck by hazard: a) On or about 06/13/14, an employee was lifting a boiler out of an elevator shaft with a Takeuchi TL 240Track Loader. The employee was exposed to the hazard of falling out of and being struck by the equipment, in that, the loader was used to lift objects which it is not designed to do.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a. On or about 06/13/14 - an employee was operating a Takeuchi TL 240 Track Loader and was not wearing a seat belt. The track loader was being used to lift a boiler out of an elevator shaft and flipped. The employee was exposed to the hazard of falling out and being struck by the equipment.
