29 CFR 1910.146(c)(3): If the employer decides that its employees will not enter permit spaces, the employer shall take effective measures to prevent its employees from entering the permit spaces and shall comply with paragraphs (c)(1), (c)(2), (c)(6), and (c)(8) of this section: a. On or about June 18, 2014, at the above located workplace, employees unloading Gluten and Dried Distillers Grains (DDG) from tractor trailers were exposed to the hazards associated with engulfment. The employer had not taken effective measures to prevent employees from entering the permit spaces.
