The employer did not evaluate the site when an odor was emitting from the excavation.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person prior to the start of work, and as needed throughout the shift, for evidence of situations that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  Employees performing work in an approximately 10 foot deep excavation were exposed to atmospheric hazards when boring operations (gas combustion engine) and welding operations were conducted. The employer's foreman did not conducted an initial inspection of the site to for such hazardous atmospheres, and they did not perform an inspection of the site when introducing equipment/operations could have created a hazardous atmosphere.
