29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  On June 25, 2014 and at times prior thereto, at this excavation site, employees were not trained as follows:  A. Employees who were required to enter and work in trenches and excavations were not trained in how to recognize hazardous conditions.   B. The employer had not designated and trained a person to be a competent person for trenching and excavation operations.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  At this excavation site, employees performing work in trenches at various depths were not provided personal protective equipment such as protective helmets (hard hats).  Employees were exposed hazards such as, but not limited to, being struck by the bucket in the event of a hydraulic failure or being struck by falling material from the bucket.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents  At this job site, an employee remained in a trench while a CASE 580 M excavator continued to excavate a trench. The employee was not wearing protective eyewear and was exposed to being struck by spoil falling from the excavator's bucket while it was in operation.
