OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to faulty equipment, such as the following, on or about 6/23/2014: The Aerial Lift truck (Model # LB-650, Serial # 1289-S0548) was not properly inspected or tested, and did not have the required Dielectric testing performed annually as required by ANSI/SIA A92.2 - 2009 (8.2.2(2), exposing employee to faulty equipment. The hazard was recognized by the employer, as evidenced by the inspection plaques attached to the equipment, which showed that the equipment has had previous inspections. The dielectric test placard showed that the last was conducted on 10/29/2012. On 6/23/2014, the employee who was operating the truck stated that he didn't know the last time the truck had been inspected. Employees were exposed to faulty equipment hazards that could cause or was likely to cause death or serious physical harm. There was feasible and useful method to correct the hazard by having the equipment properly maintained and inspected per the manufactures recommendations and the applicable ANSI Standards (ANSI/SIA A92.2).
