29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the trench was not sloped at an adequate angle:    At this job site two employees worked in a trench greater than 5 foot deep without a protective system. The west and south walls of the trench were vertical.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigied support that will not deflect, and/or a grasping device was not provided to assist emmployees in mounting and dismounting the ladder    At this job site a section of a metal, portable ladder was used to egress from a trench greater than 5 foot in depth. The ladder section's side rails did not extend 3 feet above ground level. There was no grab bar for employees to hold onto when mounting and dismounting the ladder section.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    At this job side a section of a portable metal ladder which had a damaged side rail was used for employee access to the trench and egress from the trench. Where the side rails rested on the floor of the trench the right hand side rail was bent and did not rest evenly on the trench floor. The ladder section had not been taken out of service or tagged or marked that it was not for use.
