OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards because of misusing portable ladders.    (a) 310 Highway 80 East in Clinton, MS - On or about July 1, 2014, employees were exposed to fall hazards because the fiberglass reinforced extension ladder did not extend 36 inches above the cooler.

29 CFR 1910.26(c)(1): Good safe practices in the use and care of ladder equipment were not employed by the users to get maximum serviceability, safety, and to eliminate unnecessary damage of equipment:    (a) 310 Highway 80 East in Clinton, MS - On or about July 1, 2014, employees were exposed to fall hazards from a 6 foot metal step ladder because top step and top cap was being used to access the roof, the ladder step ladder was not fully opened with the spreader bars locked in place, and the ladder did not extend 36 inches above the landing on the roof.    Among others, one feasible and useful abatement method to correct these hazards is to; train employees in the proper selection and use of portable ladders as required in ANSI A14.2 - 2000 for portable metal ladders.
