OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries in the event of a hydraulic or mechanical failure while using automotive lifts in the workplace.    a) Establishment: 1717 New Jersey 10 Morris Plains, NJ     The employer assigned employees to utilize an automotive lift with defective and/or missing components which compromise the lift ability to keep automobiles elevated. Employees utilize the lift to pick up vehicles and conduct maintenance work in close proximity to them.      Violation observed on or about 07/02/2014     b) Establishment: 1717 New Jersey 10 Morris Plains, NJ     Automotive lifts were not inspected in accordance with manufacturer specifications contained in the Rotary-VLXS10 owner/operator manual.    Violation observed on or about 07/02/2014    c) Establishment: 1717 New Jersey 10 Morris Plains, NJ     Rated load capacity for Rotary-VLXS10 lift was not legible.    Violation observed on or about 07/02/2014

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    a. 1717 State Route 10 Morris Plains, NJ (Establishment)    The employer's lockout/tagout program was not fully developed and implemented by the employer, where employees maintain/service automobiles while using machinery such as but not limited to Rotary VLXS10 Automotive Lift and other machinery in the establishment, as periodic inspections were no conducted and information in the employers program was not site specific.     Violation occurred on or about 07/02/2014
