29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.    On or about July 3, 2014:  a) Employee working from an aerial lift installing Styrofoam material to receive stucco was exposed to fall hazards of approximately 16 feet, when they were not attached to the boom or basket.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about July 3, 2104:  a) Employees were exposed to fall hazards of approximately 12 feet while prepping building store front area to receive stucco material, without the use of fall protection systems.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about July 3, 2014:  a) Employee performing work at an elevation of approximately 12 feet,were not properly trained to be able to recognize or minimize fall hazards being exposed to.
