29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration: a) North and West Sides of Building - The person designated as the project competent person qualified in scaffold dismantling did not provide fall protection during the dismantling of a fabricated frame scaffold where fall protection was both feasible and did not create a greater hazard and did not ensure precautions were taken that would prevent tools and materials from falling from scaffold platforms upon workers below. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.451(g)(2): The employer did not provide fall protection for employees erecting or dismantling supported scaffolds: a) West Side of Building - On or about 07/03/2014, a laborer was exposed to a 50 ft. fall from the top platform of a fabricated frame which he was in the process of disassembling and was not provided with fall protection where such protection was both feasible and did not create a greater hazard to the laborer. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.451(h)(2): Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section: a) North Side of Building, Fifth Floor - On or about 07/02/2014, mason tenders mixing mortar in a staging area which was located directly below occupied fabricated frame scaffold platforms were not provided with protection from falling objects, including, but not limited to, buckets, bricks and hand tools. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
