29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. a) Worksite, 24 Farmstead Lane, Water Mill, NY- Employee was bringing roofing shingles up to a roof using a ladder with deteriorated rails and rungs; on or about 7/5/14. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards. a) Worksite, 24 Farmstead Lane, Water Mill, NY- Employees were using a 24' fiberglass extension ladder with no adjustable feet as well as visible deterioration to carry bundles of roofing shingles to the roof of a residence; on or about 7/5/14. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
