29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1m) above a lower level was not protected from falling to that lower level. Paragraphs (g)(1)(i) though (vii) establish the types of fall protection to be provided to employees on each type of scaffold. Paragraph (g)(2) addresses fall protection for scaffold erectors and dismantlers:       a)   During masonry activities, employees were exposed to fall hazards on the 50 ft scaffold at the back of the building;  the scaffold had multiple platforms which had no midrails or endrails for fall protection.         Location:  182 W 82nd Street, New York, N.Y.        On or about  7/9/2014       NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(h)(2):  Where there is the danger of tools, materials, or equipment falling from a scaffold and striking employees below, the employer did not provide    preventive measures; to include:   i)      Barricade the area below the scaffold; or   ii)     Erect toeboards on the scaffold; with minimum height           3.5 inch toeboard; or   iii)    Install paneling or screening if toeboard is insufficient            height; or   iv)    Install a guardrail system with openings small enough            to prevent passage of falling objects; or   v)      Erect a canopy structure, debris net, or catch platform            above employees working below the scaffold.       a)   Employees were exposed to falling objects during construction activities at the back of the building where stray cinderblocks were left on various levels of the 50 ft tall scaffold; there were toeboards or other means to prevent falling objects. Employee was standing above uncapped rebar when doing masonry work on a window opening; located at the back of the building.       Location:  182 W 82nd Street, New York, N.Y.
