OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by powered industrial trucks that do not have back-up alarms or other warning devices:   a) On July 7, 2014 employees operated and worked near the Caterpillar and Hyster powered industrial trucks (forklifts) that did not have functioning back-up alarms in place.   Note) Abatement certification IS required for this item.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training required by this paragraph (l):  a)  On July 7, 2014 the employer did not have a program in place to provide and /or ensure that each employee who operates a forklift had been formally trained in the fundamentals of the powered industrial truck, effects the operating environment has on the truck operation, safe operation, rules and practices, and operational training practice.
