OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of being ran over which are causing or likely to cause death or serious physical harm to employees:   This violation was observed on or about July 14, 2014, in the Wedgewood Falls Subdivision along Parnevik Pl. in Conroe, TX, where an employee was exposed to a run over hazard when riding on the side step of a Case Loader, Model 570MXT, S/N 657532, without the Loader being designed to carry extra passengers.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to ensure that employees are not exposed to run over hazards.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.  The employer does not ensure employees wear personal protective equipment. This violation was observed on or about July 14, 2014, at or near 1900 Parnevik Pl. in Conroe, TX, where an employee was exposed to a crush hazard while operating a Case Loader, Model 570MXT, S/N 657532, without wearing a seatbelt.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, are provided, used, or maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.
